SUBJECT: Fiscal Note for HB 2712 by House Committee on Insurance
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2712 is
respectfully submitted to your committee.
HB 2712 would specify that a contract between an insurer and a dentist cannot limit the
fee a dentist may charge for a service that is not covered or include a provision that both allows
the insurer to deny a service that ordinarily would have been covered and prohibits the dentist from
billing for and collecting the amount owed from the patient for such service if there is a dental
necessity. The bill defines dental necessity.
The Department of Administration indicates that the dental insurer of the State Employee
Health Plan (Plan), Delta Dental of Kansas, states that because the services affected by the bill
would not be covered services by the Plan, any additional expenditures would be paid by
consumers. Based on 2023 claims data, Delta Dental estimates that Plan members would
potentially be subject to $2,998,776 for dental services with no increase in dental benefits.
The Insurance Department indicates enactment of the bill would have no fiscal effect on
the agency. Any fiscal effect associated with HB 2712 is not reflected in The FY 2025 Governor’s
Budget Report.
