Dear Representative Williams:
SUBJECT: Fiscal Note for HB 2726 by House Committee on K-12 Education Budget
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2726 is
respectfully submitted to your committee.
HB 2726 would require school districts to provide timely implementation of an
individualized education program (IEP) and advanced enrollment for certain children who are new
to a school district. For a child who would transfer from one Kansas school district to another, the
IEP would be implemented as written if the parents and school district agree. If the appropriate
school district staff do not agree to implement the current IEP, the school district would conduct
all necessary assessments and, within 30 days of the date the child enrolls in the school district,
develop, and implement a new IEP for the child. If a child would transfer from an out-of-state
district, the appropriate school district staff would conduct any assessments determined necessary
and, within 30 days of the date the child enrolls in the school district, develop, and implement a
new IEP for the child.
In addition, a member of the Armed Forces of the United States, the National Guard or any
other reserve component of the armed forces who has received relocation orders and whose
anticipated residence will be within the state would be authorized to enroll a dependent child in a
school district and register for courses in advance of a member's relocation. Once enrolled, the
child would be permitted to attend classes and receive services free of charge in the same manner
as if the child was already a resident of the school district. The school district would waive any
proof of residency requirements until the member's family resides within the school district. The
State Board of Education would be able to adopt rules and regulations necessary to implement
provisions of the bill.

The Department of Education indicates that the enactment of the bill would have no fiscal
effect. The Kansas Association of School board indicates that the enactment of the bill could result
in additional administrative costs for school districts; however, a fiscal effect cannot be estimated.
