SUBJECT: Fiscal Note for HB 2686 by Representative Vic Miller
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2686 is
respectfully submitted to your committee.
HB 2686 would require all prescribers (physicians, physician assistants, and advanced
practice nurses) to discuss with a patient and the patient’s legal guardian the risks and dangers
associated with the drugs prescribed prior to prescribing a Schedule II controlled substance or any
opioid medication. The prescriber would be required to include risks of addiction and overdose,
reason for the prescription, alternative treatment options, and additional risks of taking the
medication. The bill would also require the prescriber to document this discussion in the patient’s
medical record. Exempt prescriptions would include those for patients in active treatment for
cancer, in hospice, receiving palliative care, in an adult care home, or being treated for substance
use disorder.
According to the Board of Pharmacy and the Board of Healing Arts, enactment of HB 2686
would have no fiscal effect on the respective Boards.
