SUPPLEMENTAL NOTE ON HOUSE BILL NO. 2679

Brief*
HB 2679 would authorize the Director of Vehicles,
Division of Vehicles, Kansas Department of Revenue
(KDOR), to waive the knowledge and skills test for driving a
commercial motor vehicle (CMV) for an applicant who
qualifies for a waiver under the military Even Exchange
Program (Program) authorized by the Federal Motor Carrier
Safety Administration.
[Note: Under the Program, an individual qualifies if the
individual:
● Is currently licensed;
● Has been employed within the previous 12 months
in a military position requiring operation of a
military vehicle equivalent to a CMV; and
● Has submitted a completed application for military
skills test waiver.]
The bill would remove rule and regulation authority of
the Secretary of Revenue regarding CMV skills tests
administered by community and technical colleges. [Note: No
rules and regulations have been promulgated under this
authority.]

Background
The bill was introduced by the House Committee on
Transportation at the request of a KDOR representative.
House Committee on Transportation
In the House Committee hearing, proponent testimony
was provided by a representative of KDOR, who stated law
already authorizes waiver of the skills test and the bill would
codify in statute a process already utilized by KDOR and help
increase the pool of qualified commercial driver’s license
holders.
Written-only proponent testimony was provided by a
representative of the Kansas Motor Carriers Association.
No other testimony was provided.
Fiscal Information
According to the fiscal note prepared by the Division of
the Budget on the bill, KDOR and the Kansas Department of
Transportation indicate enactment of the bill would not have a
fiscal effect on agency operations.
