Dear Senator Warren:
SUBJECT: Fiscal Note for SB 440 by Senate Committee on Judiciary
In accordance with KSA 75-3715a, the following fiscal note concerning SB 440 is
respectfully submitted to your committee.
SB 440 would revoke the authority to suspend driving privileges and licenses due to
nonpayment of fines or court costs from traffic citations, which would be applied retroactively to
any person whose driver’s license was suspended prior to July 1, 2024. The bill would also remove
references to the failure to pay traffic fines or court costs as well as language indicating that the
failure to pay fines or court costs may result in suspension of the person’s driver’s license.
The Office of Judicial Administration (OJA) indicates enactment of the bill would require
the Judicial Branch to reprogram its case management system, which would result in additional
expenditures. OJA notes that because the bill’s provisions would apply retroactively, it would
increase the workload for district court clerks and OJA staff. Prior to the completion of the
required programming, staff would need to find an alternative solution to comply with the
provisions of the bill. OJA notes that staff would have to learn the new programming and how to
apply it in the case management system. In addition, staff would need to develop new reports or
update existing reports. OJA also states enactment of the bill could result in a decrease in revenue
from traffic court costs and fines, which would have been deposited into the State General Fund
and other state funds. However, a precise fiscal effect cannot be estimated.
The Department of Revenue indicates enactment of the bill could have a fiscal effect on
the agency, but the effect cannot be determined at this time. The agency states that the $100
reinstatement fee would no longer be collected on certain driver’s license suspensions, of which
29.41 percent is remitted to the Division of Vehicles Operating Fund with the remaining amount
split between the Community Alcoholism and Intoxication Program Fund, the Juvenile

Alternatives to Detention Fund, and the State General Fund. The agency indicates the fiscal effect
would be negligible to the agency and could be absorbed within existing resources. Any fiscal
effect associated with SB 440 is not reflected in The FY 2025 Governor’s Budget Report.
