SUBJECT: Fiscal Note for HB 2641 by House Committee on Education
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2641 is
respectfully submitted to your committee.
HB 2641 would require each school district to adopt policies and procedures to govern the
use of privately-owned electronic communication devices. The policies and procedures would
include the prohibition of students from using any privately-owned electronic communication
devices at school during the normal hours of the school day, including pass periods and in the
classroom. The policies and procedures would be required to set disciplinary consequences that
would occur if a student would violate the policies and procedures. The bill would outline certain
conditions where privately-owned communication devices could be used, including the
implementation of a student’s individualized education program, or if authorized by a teacher or
administrator for education purposes. However, the authorization could not be part of a classroom
reward or free time.
The Department of Education indicates that the enactment of the bill would not affect state
aid to school districts. The Division of the Budget notes that the bill would require school districts
to prepare policies and procedures for the use of privately-owned electronic communication
devices; however, any additional costs incurred by school districts would likely be negligible.
The Kansas Association of School Boards indicates that the fiscal effect of the bill’s
enactment cannot be estimated; however, it is likely that school districts would have to purchase

additional equipment and devices if students cannot bring their own devices to access coursework
and curricular material if the use would not fit into the bill’s exemptions.
