SUPPLEMENTAL NOTE ON SENATE BILL NO. 428

Brief*
SB 428, as amended, would amend law concerning the
requirement that the board of education of a school district
(board) conduct a needs assessment of each attendance
center in the district.
The bill would require each needs assessment to
include input from the following persons:
● Board members;
● Teachers employed by the school district;
● School site councils; and
● Attendance center administrators.
The bill would require that each member of the board
receive state assessment results for the school district each
year. The results would include the number of students who
are scoring at a level 3 or 4 and scoring at a level 1 or 2 on
such assessments.
The bill would clarify that in the minutes of the meeting
at which the board approves its annual budget, the board is
required to include a statement that the needs assessment
was conducted by the board.
The bill would also require that when moneys are
allocated to a fund or existing moneys are reallocated from

one fund to another fund, such allocation or reallocation be
identified in the budget and in the budget summary.

Background
The bill was introduced by the Senate Committee on
Education at the request of a representative of the Kansas
Policy Institute (KPI).

Senate Committee on Education
In the Senate Committee hearing, a representative of
KPI and current and former school board members from USD
265 (Goddard), USD 453 (Leavenworth), and USD 469
(Lansing) provided proponent testimony. The proponents
generally stated the bill would require board members,
teachers, and school administrators to work together to help
improve student achievement, help board members make
informed decisions on budgets, and ensure that there is
proper documentation for the needs assessments.
Written-only proponent testimony was submitted by a
representative of the Kansas School Board Resource Center,
and a private citizen.
Opponent testimony was provided by a representative
of the Kansas Association of School Boards (KASB) stating
that boards have made sound local decisions to assess
student needs and budget for increased student achievement
without the provisions of the bill and solutions for student
success are most effective when they begin at the local level.
Written-only opponent testimony was submitted by a
representative of USA-Kansas and the Kansas School
Superintendents Association.

The Senate Committee amended the bill to remove
language that would have classified certain scoring levels as
“proficient” or “academically prepared.”

Fiscal Information
According to the fiscal note prepared by the Division of
the Budget on the bill, as introduced, the State Department of
Education indicates enactment of the bill would have no fiscal
effect.
The KASB indicates enactment of the bill would require
additional involvement of local boards of education in the
school building needs assessment process, and the bill would
require additional administrative processes for local boards of
education. However, the KASB is unable to estimate the
effect.
