SUBJECT: Fiscal Note for SB 418 by Senate Committee on Judiciary
In accordance with KSA 75-3715a, the following fiscal note concerning SB 418 is
respectfully submitted to your committee.
SB 418 would require the clerk of the appellate courts to publish a list of cases each month
of the Supreme Court and the Court of Appeals in which a decision has not been entered and filed
within six months of submission and a list of cases in which a petition for review has not been
granted or denied within six months of submission. The bill would require the list to be available
on the Supreme Court’s website and to be sent to the House and Senate Judiciary Committees, the
Speaker of the House, the President of the Senate, the Attorney General, and the Governor.
The Office of Judicial Administration indicates enactment of the bill would require the
clerk of the appellate court to publish a list of certain cases monthly. The Office estimates it will
take one employee approximately five days each month to produce this list. While this requirement
would increase the workload of the clerk, it is anticipated that this duty can be absorbed within
existing resources by current staff. The Office notes that the additional workload could result in
delays in the clerk of the appellate court performing existing duties. Any fiscal effect associated
with SB 418 is not reflected in The FY 2025 Governor’s Budget Report.
