Dear Representative Williams:
SUBJECT: Fiscal Note for HB 2612 by House Committee on K-12 Education Budget
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2612 is
respectfully submitted to your committee.
HB 2612 would require the State Board of Education’s accreditation system for school
districts to be in compliance with all applicable state laws, including all rules and regulations. Any
school district that would not be in compliance with any laws, including rules and regulations,
could not be accredited. If a school district would not be accredited, the school district would
notify each parent in writing.
After not being accredited, a school district may only become accredited if an audit would
be conducted by the Department of Education to determine that the school district has made the
changes necessary to be in compliance. Finally, the bill would authorize the State Board of
Education to establish a process to allow an individual to challenge a determination of a school
district compliance or noncompliance with state laws or rules and regulations.
The Department of Education indicates the enactment of HB 2612 would have no fiscal
effect. The Division of the Budget notes that any administrative expenses that would be required
to implement the bill would be performed by existing staff of the agency. The Kansas Association
of School Boards indicates that the enactment of the bill may result in additional administrative
expenses for school districts; however, a fiscal effect cannot be estimated.
