SUBJECT: Fiscal Note for SB 373 by Senate Committee on Federal and State Affairs
In accordance with KSA 75-3715a, the following fiscal note concerning SB 373 is
respectfully submitted to your committee.
SB 373 would prohibit public funds received, held, or expended by any governmental
entity to be used directly or indirectly for lobbying, to pay membership dues to an association that
is engaged in lobbying, for the purpose of employing or contracting for the service of any person
whose duty and responsibility includes lobbying, or for a direct or indirect gift or campaign
contribution to any elected official, officer, or employee of any governmental entity. Violations
of the bill by any classified employee in the civil service would be considered personal conduct
detrimental to the state service and would be a basis for suspension, demotion, or dismissal.
Violations of the bill by any unclassified employee would result in the employee being subject to
discipline up to and including termination. The bill also allows the Governmental Ethics
Commission to assess a civil fine against any person for a violation of the bill of up to $1,000 for
a first violation, $3,000 for a second violation, and $8,000 for a third or subsequent violation.
Fines would be deposited into the Governmental Ethics Fee Fund.
The Governmental Ethics Commission states that enactment of the bill would result in a
decrease in lobbyist registration fees of approximately $8,200 beginning in FY 2025. The
Commission indicates that if the loss in fees results in ending balance instability, enactment of the
bill could require it to request additional funding from the State General Fund to maintain
operations in the future. Any fiscal effect associated with SB 373 is not reflected in The FY 2025
Governor’s Budget Report.
