SUBJECT: Fiscal Note for SB 364 by Senate Committee on Ways and Means
In accordance with KSA 75-3715a, the following fiscal note concerning SB 364 is
respectfully submitted to your committee.
SB 364 would extend the statute of limitations for childhood sexual abuse claims. The bill
would permit an action for damages for an injury or illness from childhood sexual abuse to be filed
at any time. The bill would also revive claims for injury or illness from childhood sexual abuse
that occurred on or after July 1, 1984.
The Office of Judicial Administration indicates that SB 364 could increase the number of
cases filed in district courts because it removes the statute of limitations to file an action related to
childhood sexual abuse. This would allow more cases to be filed with the court that otherwise
would not have been filed. This, in turn, would increase the time spent by district court judicial
and nonjudicial personnel in processing, researching, and hearing cases. Nevertheless, until the
courts have had an opportunity to operate under the provisions of SB 364, an accurate estimate of
the fiscal effect on expenditures by the Judicial Branch cannot be given. SB 364 would have no
other fiscal effect on revenues to the Judicial Branch. However, the bill could result in the
collection of docket fees in those cases filed under the provisions of the bill, which would be
deposited in the State General Fund.
The Department for Children and Families indicates that SB 364 would have not fiscal
effect on the agency. Any fiscal effect associated with SB 364 is not reflected in The FY 2025
Governor’s Budget Report.
