SUBJECT: Fiscal Note for SB 358 by Senate Committee on Federal and State Affairs
In accordance with KSA 75-3715a, the following fiscal note concerning SB 358 is
respectfully submitted to your committee.
SB 358 would prohibit any Kansas board of education from prohibiting, banning, or
restricting access to any book or other media based upon: (1) partisan or doctrinal disapproval; or
(2) the origin, background, or view of the person contributing to the creation of the book or other
media.
In addition, the bill would allow a board of education to prohibit, ban, or restrict access to
a book or other media under certain conditions. Upon presenting a signed request with at least 5.0
percent of the qualified electors in a school district, a resident individual of a school district could
request a ban or restriction. However, the individual would have to attest to reading the book in
its entirety, or viewing the media in its entirety, and would have to provide a detailed list of the
reasons for the ban or restriction. The bill would not apply to any age-based restriction on obscene
or pornographic material. In addition, the bill’s provisions could not be construed to require a
school district to acquire or provide any specific book or other media. The bill would provide
similar language regarding local libraries, as well.
The Department of Education states the enactment of SB 358 would have no fiscal effect
on state aid to school districts. The State Library states the enactment of the bill would have no
fiscal effect.
The Kansas Association of Counties indicates that local government may incur additional
costs to require the verification of signatures depending on the number of requests to ban or restrict

material. Otherwise, the organization indicates that the bill would have no fiscal effect. The
League of Kansas Municipalities and the Kansas Association of School Boards indicate the
enactment of the bill would have no fiscal effect.
