SUPPLEMENTAL NOTE ON HOUSE BILL NO. 2530
As Amended by Senate Committee on Financial
Institutions and Insurance

Brief*
HB 2530, as amended, would amend the definition of
“person” in law regarding violations of insurance law by
removing references to specific entities under the jurisdiction
of the Commissioner of Insurance (Commissioner) for the
purpose of determining violations of Kansas insurance law.
The bill would become effective on publication in the
Kansas Register.

Background
The bill was introduced by the House Committee on
Insurance at the request of a representative of the Kansas
Insurance Department (Department).
[Note: A companion bill, SB 340, was introduced in the
Senate.]

House Committee on Insurance
In the House Committee hearing, proponent testimony
was provided by a representative of the Department. The
proponent indicated the bill would eliminate the reference of
“automobile club” in the definition of “person,” as automobile
clubs are no longer under the jurisdiction of the
Commissioner.

The House Committee amended the bill to remove all
specific references to entities under the jurisdiction of the
Commissioner.

“automobile club” from the definition of “person.”]

Senate Committee on Financial Institutions and
Insurance
In the Senate Committee hearing, a representative of
the Department provided proponent testimony, indicating the
bill would eliminate the reference of “automobile club” in the
definition of “person,” as automobile clubs are no longer
under the jurisdiction of the Commissioner. The
representative stated the House Committee on Insurance
amended the bill to remove all entities not under the
jurisdiction of the Commissioner; however, the same
amendment was not offered when the companion bill, SB
340, was heard in the Senate Committee.
No other testimony was provided.
The Senate Committee amended the bill to change the
effective date to publication in the Kansas Register.

Fiscal Information
According to the fiscal note prepared by the Division of
the Budget on the bill, as introduced, the Department
indicates enactment of the bill would have no fiscal effect
because automobile clubs are no longer under the jurisdiction
of the Department.
