Dear Representative Williams:
SUBJECT: Fiscal Note for HB 2514 by Representative K. Williams, et al.
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2514 is
respectfully submitted to your committee.
HB 2514 would change current law regarding school district open enrollment. The bill
would create an enrollment priority for students who are residents of Kansas over students who
are residents of another state. The bill would also provide for continued enrollment for a non-
resident student who attended a school on or after school year 2023-2024, unless the student would
be deemed by the school districts as “not in good standing.” Finally, the bill would require any
student transfer policy revisions to be published on a school district’s website.
The Department of Education indicates the enactment of HB 2514 would have no fiscal
effect on the agency’s operations. The Kansas Association of School Boards indicates that the bill
could affect school finance calculations in state boarder districts when Kansas students would get
preferential enrollment over out-of-state students. In the case where a Kansas student would get
preferential treatment over an out-of-state student, the school district would get to count the Kansas
resident student as 1.00 FTE student in the school finance formula, where the out-of-state student
would be counted as 0.50 FTE student. Although the fiscal effect of HB 2514 cannot be estimated,
the Division of the Budget notes that any changes to the statewide student FTE count resulting
from the open enrollment policy changes contained in HB 2514 would likely be negligible in the
overall school finance formula calculations. Any fiscal effect associated with HB 2514 is not
reflected in The FY 2025 Governor’s Budget Report.
