SUBJECT: Fiscal Note for HB 2489 by Representatives K. Williams and Fairchild
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2489 is
respectfully submitted to your committee.
Current law gives the Legislature, under certain conditions, the right of first refusal to
purchase school district buildings that a district would like to dispose of or sell. The law outlines
the legislative procedures, as well as notification requirements of school districts for this process.
HB 2489 would amend current law regarding this policy with a definition of a school “building,”
which would mean any building that was used in any prior school year as an attendance center for
students enrolled in kindergarten or grades one through 12.
According to the Department of Education, the enactment of HB 2489 would have no fiscal
effect on state aid to school districts. Legislative Administrative Services indicates that the
enactment of the bill would have no fiscal effect. The Kansas Association of School Boards
indicates that the definition of “building” in HB 2489 would likely allow for quicker disposal of
buildings that have not been used as an attendance center. However, the organization does not
have data that could estimate a fiscal effect.
