Senate Concurrent Resolution No. 1614

1 A PROPOSITION to amend section 2 of article 2 of the constitution of
2 the state of Kansas; providing for term limits for senators and
3 representatives.

5 Be it resolved by the Legislature of the State of Kansas, two-thirds of the
6 members elected (or appointed) and qualified to the Senate and two-
7 thirds of the members elected (or appointed) and qualified to the
8 House of Representatives concurring therein:
9 Section 1. The following proposition to amend the constitution of
10 the state of Kansas shall be submitted to the qualified electors of the state
11 for their approval or rejection: Section 2 of article 2 of the constitution of
12 the state of Kansas is hereby amended to read as follows:
13 "ยง 2. Senators and representatives. (a) The number of
14 representatives and senators shall be regulated by law, but shall not
15 exceed one hundred twenty-five 125 representatives and forty 40
16 senators. Representatives and senators shall be elected from single-
17 member districts prescribed by law. Representatives shall be
18 elected for two year two-year terms. Senators shall be elected for
19 four year four-year terms. The terms of representatives and
20 senators shall commence on the second Monday of January of the
21 year following election.
22 (b) (1) From and after January 13, 2025, no individual shall
23 be elected as a representative for more than six two-year terms.
24 (2) From and after January 13, 2025, no individual shall be
25 elected as a senator for more than three four-year terms.
26 (3) From and after January 13, 2025, no individual who has
27 been elected to serve as a representative then elected to serve as a
28 senator or elected to serve as a senator and then elected to serve
29 as a representative shall serve longer than a total of 16 years.
30 (4) For the purpose of computing the time period under either
31 paragraph (1) or (2), no time spent serving as either a
32 representative or senator prior to January 13, 2025, shall be
33 counted."
34 Sec. 2. The following statement shall be printed on the ballot with
35 the amendment as a whole:
36 "Explanatory statement. This amendment would limit an

1 individual's service as a state representative to six two-year
2 terms and an individual's service as a state senator to three
3 four-year terms starting on January 13, 2025. Any terms of
4 service occurring prior to January 13, 2025, would not be
5 subject to this limitation. Further, no individual may serve as
6 a representative and then as a senator or as a senator and
7 then as a representative for more than a total of 16 years.
8 "A vote for this proposition would term limit an individual's
9 service as a state representative or state senator.
10 "A vote against this proposition would retain the current
11 constitutional provisions that impose no limitations on the
12 number of terms an individual may serve as a representative
13 or as a senator."
14 Sec. 3. This resolution, if approved by two-thirds of the members
15 elected (or appointed) and qualified to the Senate, and two-thirds of the
16 members elected (or appointed) and qualified to the House of
17 Representatives shall be entered on the journals, together with the yeas
18 and nays. The secretary of state shall cause this resolution to be published
19 as provided by law and shall cause the proposed amendment to be
20 submitted to the electors of the state at the general election in November
21 in the year 2024, unless a special election is called at a sooner date by
22 concurrent resolution of the legislature, in which case it shall be
23 submitted to the electors of the state at the special election.
