Dear Senator Thompson:
SUBJECT: Fiscal Note for SB 328 by Senator Holland
In accordance with KSA 75-3715a, the following fiscal note concerning SB 328 is
respectfully submitted to your committee.
Under current law, if the Governor determines that it is in the best interest of the state, the
Lieutenant Governor can serve as a secretary of a state agency or a department head if appointed
by the Governor. SB 328 would repeal this law and would state that the Lieutenant Governor
could not serve as a secretary of a state agency or as a department head. Also, the bill would
prohibit any employee of the Executive Branch to be a member of the Legislature. However, this
restriction would not apply to any person employed by an education institution under the
management of the Board of Regents. Any member of the Legislature who would accept
employment contrary to the provisions of the bill would forfeit being a member of the Legislature.
The enactment of SB 328 would have no fiscal effect on state operations. Any fiscal effect
would be limited to individuals who would be affected by SB328.
