Dear Senator McGinn:
SUBJECT: Fiscal Note for SB 312 by Senate Committee on Assessment and Taxation
In accordance with KSA 75-3715a, the following fiscal note concerning SB 312 is
respectfully submitted to your committee.
SB 312 would prohibit public utility companies from exercising eminent domain unless
approved by the board of county commissioners where the relevant property is located. The bill
would not apply to municipally owned utility companies.
The Kansas Corporation Commission and the League of Kansas Municipalities indicate
that enactment of SB 312 would not have a fiscal effect. According to the Kansas Association of
Counties, SB 312 would have an unknown fiscal effect on counties, as evaluation of eminent
domain requests may increase staffing costs for county governments.
