SUBJECT: Fiscal Note for SB 266 by Senate Committee on Ways and Means
In accordance with KSA 75-3715a, the following fiscal note concerning SB 266 is
respectfully submitted to your committee.
SB 266 would require all law enforcement agencies in the state to adopt additional written
policies that require law enforcement officers, when having determined a person is a victim of
domestic violence, to provide the victim with a notice regarding certain rights and to conduct a
lethality assessment. The notice would state that the victim has the right to request charges be
pressed against their assailant, to request protection from harm from cooperation with law
enforcement and prosecution efforts, to be informed of financial assistance and other social
services available as a result of being a victim, and to petition for a protective order. The bill
would require a law enforcement officer who interviews a victim of domestic violence to assess
the potential for danger by asking a series of questions provided on a lethality assessment form.
Based upon the results of the assessment, the law enforcement agency would be required to make
appropriate referrals to shelters, domestic violence intervention programs, and other social services
for the victim.
The Kansas Highway Patrol, the Kansas Bureau of Investigation, and the Office of Judicial
Administration indicates enactment of the bill would not have a fiscal effect.
The League of Kansas Municipalities indicates enactment of the bill would increase costs
to local law enforcement agencies to enforce the provisions of the bill and provide training. The
League also notes that local emergency responder costs may decrease if further domestic violence
incidents are prevented. However, a fiscal effect cannot be estimated.

The Kansas Association of Counties indicates enactment of the bill could increase costs to
county law enforcement to provide the notice and lethality assessment and ensure that all
responding officers have the correct information to provide victims. However, a fiscal effect
cannot be estimated.
