SUBJECT: Fiscal Note for HB 2407 by House Committee on Child Welfare and Foster
Care
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2407 is
respectfully submitted to your committee.
Under current law, a nonacademic test (questionnaire, survey, or examination) containing
any questions about the personal and private attitudes, values, beliefs, or practices of a student or
family, friends or peers cannot be administered to any student in kindergarten through grade 12
unless the parent or guardian gives written consent. The parent has to be informed in writing not
more than four months in advance of the administration of the test.
HB 2407 would amend current law to state that no test regarding personal beliefs could be
given without each student being informed that participation is voluntary. In addition, the parent
or guardian may opt out of the student participating in the test. In addition, the results of these
types of tests would only be reported as aggregate data. The bill would specify that school
counselors or other school-based health professionals would not be prohibited from providing
counseling services to a student, including the administration of tests and forms. Any information
obtained through the tests would not be permitted to be stored on personal devices, such as laptops,
mobile phones, or tablets.
The Department of Education indicates the enactment of HB 2407 would have a negligible
fiscal effect on administrative costs for school districts.
