SUBJECT: Fiscal Note for HB 2402 by House Committee on Federal and State Affairs
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2402 is
respectfully submitted to your committee.
HB 2402 would prohibit self-service storage facilities from being located within 1,000 feet
of a licensed childcare facility and real property used by schools for student instruction, attendance,
or extracurricular activities for students in kindergarten through grade 12. The prohibitions would
begin July 1, 2023 but would not apply to existing facilities in operation on July 1, 2023.
According to the Office of the Attorney General, enactment of HB 2402 would not have a
fiscal effect on agency operations. The Kansas Association of Counties and the Kansas League of
Municipalities report that the bill would not have a fiscal effect on local governments.
