SUPPLEMENTAL NOTE ON HOUSE BILL NO. 2406

Brief*
HB 2406 would amend provisions of the Kansas
Personal and Family Protection Act (Act) concerning the
carrying of a concealed handgun by an off-duty law
enforcement officer (officer).
Current law allows an officer to carry a concealed
handgun in any building where an on-duty officer could carry
such weapon, regardless of whether the building has
restricted the carrying of concealed handguns pursuant to the
Act and provided the officer otherwise complies with
conditions listed in the Act.
The bill would specify that in buildings where an officer
may carry a concealed handgun, no person of authority for
the building shall require, request, or record personal
information of the officer.
The bill would provide that personal information includes
but is not limited to the officer’s:
● Email address;
● Home phone number; or
● Home address.
The bill would also specify that the officer could not be
required to wear anything identifying the officer’s status as a
law enforcement officer, or as being armed.

Background
The bill was introduced by the House Committee on
Federal and State Affairs at the request of a representative of
the Kansas Association of Chiefs of Police, Kansas Peace
Officers Association, and Kansas Sheriffs Association. [Note:
Provisions of this bill are similar to those of 2022 HB 2677.]

House Committee on Federal and State Affairs
In the House Committee hearing on February 21, 2023,
proponent testimony was provided by a representative of the
Kansas Association of Chiefs of Police, Kansas Peace
Officers Association, and Kansas Sheriffs Association. The
proponent provided examples of officers having to provide
personal information in order to carry a concealed handgun
and stated wristbands or other identifiers could place an
officer at risk.
No other testimony was provided.

Fiscal Information
According to the fiscal note prepared by the Division of
the Budget on the bill, the Kansas Bureau of Investigation
and Kansas Highway Patrol both indicate enactment of the
bill would have no fiscal effect.
