SUBJECT: Fiscal Note for HB 2369 by Representative Haswood
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2369 is
respectfully submitted to your committee.
HB 2369 would enact the Kansas Indian Child Welfare Act. The bill would create
additional requirements for child custody proceedings involving Indian children and require the
Secretary of the Department for Children and Families to enter into agreements with Indian tribes
in Kansas regarding the care and custody of Indian children and jurisdiction over child custody
proceedings.
The Office of Judicial Administration indicates that HB 2369 would have a fiscal effect on
expenditures of the Judicial Branch. The bill contains requirements and procedures that judges
and nonjudicial staff must follow which would increase the workload of district court personnel.
Nevertheless, until the courts have had an opportunity to operate under the provisions of HB 2369,
an accurate estimate of the fiscal effect on expenditures by the Judicial Branch cannot be given.
The Department for Children and Families indicates that HB 2369 would not have a fiscal
effect on the agency. Any fiscal effect associated with HB 2369 is not reflected in The FY 2024
Governor’s Budget Report.
