Dear Senator Warren:
SUBJECT: Fiscal Note for SB 188 by Senate Committee on Judiciary
In accordance with KSA 75-3715a, the following fiscal note concerning SB 188 is
respectfully submitted to your committee.
SB 188 would remove an affirmative defense for public, private, and parochial schools for
the crime of displaying material that is harmful to minors when the material was part of or incident
to an approved course or program of instruction. The bill would include technical amendments.
The Office of Judicial Administration indicates the enactment of SB 188 could increase
revenues to and expenditures by the Judicial Branch from additional time spent by district court
judicial and nonjudicial personnel in processing, researching, and hearing cases; however, a fiscal
effect cannot be estimated. The Kansas Department of Education indicates the enactment of SB
188 would have a negligible fiscal effect on school districts. Any fiscal effect associated with SB
188 is not reflected in The FY 2024 Governor’s Budget Report.
