SUBJECT: Fiscal Note for SB 178 by Senator Haley
In accordance with KSA 75-3715a, the following fiscal note concerning SB 178 is
respectfully submitted to your committee.
SB 178 would amend existing law relating to judicial foreclosure public auctions, adding
a definition of “public auction” that means an auction sale open to the public that is held in person
at a physical location in the county and conducted in a manner that permits the public to observe
bids as they are submitted. Electronic bids submitted in person would be allowable under this
definition, but no auction or bidding could be conducted solely online or by electronic means. The
bill would be effective upon publication in the Kansas Register.
The Kansas Judicial Branch indicates that enactment of SB 178 would not have a fiscal
effect. The Kansas League of Municipalities and the Kansas Association of Counties indicate that
SB 178 would not have a fiscal effect on cities or counties.
