Dear Senator Baumgardner:
SUBJECT: Fiscal Note for SB 167 by Senate Committee on Education
In accordance with KSA 75-3715a, the following fiscal note concerning SB 167 is
respectfully submitted to your committee.
SB 167 would require certain school employees to receive up to one hour of training in
seizure recognition and related first aid beginning with the 2023-2024 school year. The training
would be required to be consistent with training programs and guidelines developed by a nationally
recognized organization focused on epilepsy. The training would include instruction in
recognizing the signs and symptoms of seizures, responding to such signs and symptoms with
appropriate steps, and administering seizure medications. The training could include online
information or materials.
The school nurse assigned to the school where training is required or the school
administrator in the absence of a school nurse, would be required to coordinate the provision of
epilepsy and seizure disorder care at the school. These individuals would be required to ensure
that all school employees are trained in each school year that have a student with a seizure disorder
enrolled. The student’s parents are to collaborate with appropriate school personnel and the
student’s doctor to create a seizure action plan to be kept on file, along with the parents’ written
authorization and doctor’s statement to administer the medication at school. This bill would
provide immunity from liability for loss or damage caused by act or omission resulting from any
training. The State Board of Education may adopt rules and regulations to implement the
provisions of the bill.

The Department of Education indicates the enactment of the bill would require school
districts to provide training for seizure recognition and related first aid; however, any fiscal effect
would be negligible because it is likely most schools would use online training.
