Dear Representative Landwehr:
SUBJECT: Fiscal Note for HB 2258 by House Committee on Health and Human Services
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2258 is
respectfully submitted to your committee.
HB 2258 would prohibit the use of conversion therapy for any individual under 18 years of
age by a person licensed by the State Board of Healing Arts, the Board of Nursing, or the Behavioral
Sciences Regulatory Board. Conversion therapy would be defined as any practice or treatment that
seeks to change an individual’s sexual orientation or gender identity, including efforts to change
behaviors or gender expressions or to eliminate or reduce sexual or romantic attractions or feelings
towards individuals of the same sex or gender. The bill would include details of what would not be
included in the practice or treatment of conversion therapy, as well as various exceptions to the
prohibition. Violations of the bill would constitute unprofessional conduct and be subject to
discipline by the licensee’s respective regulatory board.
According to the Kansas State Board of Nursing, enactment of HB 2258 would result in
increased costs estimated to be under $1,000 related to revision of regulations, public hearings, and
publication in the Kansas Register. The Behavioral Sciences Regulatory Board and the Kansas State
Board of Healing Arts indicate that passage of the bill could result in an increase of investigations but
the number of licensees that might violate the provisions of the bill could not be estimated. Both
agencies report the additional expenditures could be absorbed within existing resources. Any fiscal
effect associated with HB 2258 is not reflected in The FY 2024 Governor’s Budget Report.
