                    SUBJECT:      Fiscal Note for SB 118 by Senate Committee on Federal and State Affairs
                  In accordance with KSA 75-3715a, the following fiscal note concerning SB 118 is
          respectfully submitted to your committee.
                  SB 118 would expand statutory duties and outline new requirements for the Secretary of
          Health and Environment related to maternal and child health, including maternal death review.
          The bill would add definitions to KSA 65-177 to include performance indicator, performance
          measure, and performance objective. The bill would extend the sunset of various provisions
          related to confidentiality of records from July 1, 2023, to July 1, 2028. A specialized review form
          would be required in maternal death cases and an external community review committee would be
          required to review certain cases as outlined in the bill.

                 According to the Kansas Department of Health and Environment, enactment of SB 118
          would increase expenditures by $57,115 in FY 2023 and each fiscal year thereafter. This would
          include $42,300 for additional perinatal quality collaborative contractors for time required to
          support local providers with using data to drive action and changes to improve maternal health,
          and $14,815 for additional staff time needed for legal work and to pull and analyze data, provide

technical assistance, and develop reports. The agency notes that existing federal funding could be
redirected to implement changes required by SB 118, however, this would reduce resources for
other maternal and child health services delivered at the local level. Any fiscal effect associated
with SB 118 is not reflected in The FY 2024 Governor’s Budget Report.
