          Dear Representative Ellis:
                    SUBJECT:      Fiscal Note for HB 2209 by House Committee on Veterans and Military
                  In accordance with KSA 75-3715a, the following fiscal note concerning HB 2209 is
          respectfully submitted to your committee.
                  Currently, state active duty National Guard members are not entitled to benefits under the
          Workers Compensation Act. HB 2209 would entitle those members to benefits under the Workers
          Compensation Act starting July 1, 2023. If a member receives federal compensation due to a
          wound, injury, disease, illness, or death that is covered by the Workers Compensation Act, the
          federal compensation would be deducted from the amount due from Kansas.
                 The Adjutant General’s Department used historical salaries paid to state active duty
          members to determine the amount of workers compensation that could be paid in FY 2024. The
          agency estimates that it could pay $19,153 in FY 2024 for workers compensation benefits. Of that
          amount, $3,200 would be from the State General Fund, $700 would be from agency fee funds, and
          $15,253 would be from federal funds.
                  The Kansas Department of Labor states that the bill would not have a fiscal effect.
          However, the Department does note that the bill could affect the amount of compensation paid by
          the State Workers Compensation Self-Insurance Fund since the bill now would have the Adjutant
          General paying benefits to National Guard members injured on the job.
                 The Department of Administration states that since the bill does not indicate who would
          be responsible for providing or paying the workers compensation provided in the bill, therefore, it

cannot estimate the fiscal effect of the bill. Any fiscal effect associated with HB 2209 is not
reflected in The FY 2024 Governor’s Budget Report.
