SUPPLEMENTAL NOTE ON SENATE BILL NO. 112

Brief*
SB 112, as amended, would permit a registered nurse
anesthetist (CRNA) to practice as an independent advanced
registered nurse to the full extent of the scope of the
licensee’s education and qualifications except for the
performance of surgery for the purpose of implantation of
medication reservoirs for drug delivery devices.
The bill would permit a CRNA to prescribe, procure,
select, order and administer any drug consistent with the
licensee’s education and qualifications but would prohibit a
CRNA from performing, inducing or prescribing, procuring, or
administering drugs for an abortion.
The bill would take effect on and after January 1, 2024,
and be in force from and after its publication in the statute
book.
Background
The bill was introduced by the Senate Committee on
Public Health and Welfare at the request of a representative
of the Kansas Association of Nurse Anesthetists.

Senate Committee on Public Health and Welfare
In the Senate Committee hearing on February 16, 2023,
proponent testimony was provided by a representative of the
Kansas Association of Nurse Anesthetists and two CRNAs,
who stated generally that the objective of the bill was to
permit nurse anesthetists to practice independently to the full
extent of their scope of practice, which would also permit
them to individually obtain Drug Enforcement Association
licenses and purchase their own supplies and medications.
The proponents also stated the bill would provide them with
prescriptive authority.
Written-only proponent testimony was received from
representatives of Americans for Prosperity, Kansas
Advanced Practice Nurse Association, Kansas Chamber of
Commerce, Kansas Chiropractic Association, Kansas Justice
Institute, Kansas State Board of Nursing, Kansas State
Nurses Association, and a surgeon, a CRNA, two
chiropractors, and three members of the nursing profession.
Opponent testimony was provided by a representative
of the Kansas Medical Society, who proposed an amendment
that would authorize CRNAs to have the same scope of
practice as advanced practice registered nurses.
Written-only opponent testimony was received from a
representative of the Kansas Chapter of the American
Academy of Pediatrics.
Written-only neutral testimony was received from a
representative of the Kansas State Board of Healing Arts.
The Senate Committee amended the bill to prohibit
CRNAs engaging in independent practice from:
● Performing, inducing or prescribing, procuring, or
administering drugs for an abortion; and

● Performing surgery for the purpose of implantation
of medication reservoirs for drug delivery devices.
Fiscal Information
According to the fiscal note prepared by the Division of
the Budget on the bill, as introduced, the Kansas State Board
of Nursing indicates enactment of the bill would have a
negligible fiscal effect. Any expenses associated with the bill
would include staff time for the revision of regulations, holding
a public hearing, and publication costs in the Kansas
Register. Communication to the Board’s licensees and
stakeholders would occur through current communication
methods with no added cost. Any fiscal effect associated with
the bill is not reflected in The FY 2024 Governor’s Budget
Report.
