SUBJECT: Fiscal Note for SB 107 by Senate Committee on Federal and State Affairs
In accordance with KSA 75-3715a, the following fiscal note concerning SB 107 is
respectfully submitted to your committee.
SB 107 would amend current law to specify that if a defendant is charged with a crime in
Article 54 of Chapter 21 of the Kansas Statutes Annotated, and the victim of the crime is deceased,
one member of the victim’s family would have the right to sit in a designated seating area at or
near the prosecution’s table during any court proceeding at which the defendant has a right to be
present, as long as sitting in such an area does not violate the defendant’s rights.
The bill specifies that the victim’s family would choose the family member who would sit
in the area and inform the prosecuting attorney of the choice at or prior to the first court proceeding
at which the family member would exercise the right. The prosecuting attorney would inform the
court of the choice for the record. The court on its own motion or upon request could change the
family member who would sit in the designated seating area and could allow more than one family
member to sit in the area.
The Office of Judicial Administration states enactment of the bill would have a negligible
fiscal effect on the operations of the Judicial Branch.
