Dear Representative Patton:
SUBJECT: Fiscal Note for HB 2183 by House Committee on Judiciary
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2183 is
respectfully submitted to your committee.
HB 2183 would remove the $250,000 cap on the amount of damages that a court or jury
may award in a wrongful death action. The bill would also eliminate requirements that a court
must not instruct juries on a cap on damages allowed and that the court must reduce an award of
damages in excess of the cap. Also, the bill would remove the requirement that expenses for the
care of the deceased which resulted from the wrongful act and funeral expenses must be included
in the cap on damages in wrongful death actions.
According to the Office of Judicial Administration, enactment of HB 2183 would have a
negligible fiscal effect on the operations of the Judicial Branch.
