SUBJECT: Fiscal Note for HB 2151 by House Committee on Federal and State Affairs
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2151 is
respectfully submitted to your committee.
HB 2151 would require the Department of Corrections to provide notification of the release
of an inmate to the district judge, prosecuting attorney, nonexpert witnesses, and lead investigator
for the case in which the inmate was convicted. The notification would be provided by letter, e-
mail, or text message. The State of Kansas and the Department of Corrections would not be liable
for any damages caused by any negligent act or omission in making the notifications.

The Department of Corrections indicates that enactment of the bill would require $66,298
from the State General Fund in FY 2024 for 1.00 FTE position to expand current registration
capacity for inmate notification services. The Department notes that it currently provides victim
and witness notification services for any Kansan who registers on its public website. Notification
of release letters are sent by mail to registrants. In FY 2022 there were 41,874 persons registered
for this service with 17,313 letters sent. In addition, members of the law enforcement community
can also request notification using the National Crime Information Center database.

The Office of Judicial Administration indicates enactment of the bill would not have a
fiscal effect on the Judicial Branch. Any fiscal effect associated with HB 2151 is not reflected in
The FY 2024 Governor’s Budget Report.
