Dear Senator McGinn:
SUBJECT: Fiscal Note for SB 86 by Senate Committee on Local Government
In accordance with KSA 75-3715a, the following fiscal note concerning SB 86 is
respectfully submitted to your committee.
SB 86 would require candidates for local office to disclose substantial interests in a
renewable energy system and would prevent local government officials who have such interests
from acting on matters relating to the renewable energy system. The bill would also expand the
definition of substantial interest in the specific case of interests in renewable energy systems. Any
contract created in violation of SB 86 would be voidable within five years of contract execution,
and any local government official found to be in violation of the Act would be required to forfeit
their office.
The Kansas Corporation Commission, Kansas Governmental Ethics Commission, Kansas
Secretary of State, and Office of the Attorney General indicate that enactment of SB 86 would not
have a fiscal effect on agency operations. According to The League of Kansas Municipalities,
enactment of SB 86 would not have a fiscal effect on cities.
