Dear Senator Erickson:
SUBJECT: Fiscal Note for SB 47 by Senate Committee on Commerce
In accordance with KSA 75-3715a, the following fiscal note concerning SB 47 is
respectfully submitted to your committee.
SB 47 would prohibit municipalities from adopting or enforcing an ordinance, resolution
or regulation that restricts, taxes, prohibits or otherwise regulates the use, disposition, or sale of
auxiliary containers or consumer merchandise. The bill includes definitions for auxiliary container
and consumer merchandise. The bill would take effect and be in force from and after its publication
in the statute book.
The League of Kansas Municipalities indicates the enactment of SB 47 would have a
negligible fiscal effect on cities. However, the bill would eliminate the ability of local
governments to tax the products specified in the bill, which would have produced additional
revenue. The Kansas Association of Counties indicates the enactment of the bill would have no
fiscal effect.
