Dear Representative Proctor:
SUBJECT: Fiscal Note for HB 2052 by House Committee on Elections
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2052 is
respectfully submitted to your committee.
HB 2052 would prohibit a public agency from providing records to a federal court for the
purpose of preparing a jury list unless there is an executed agreement between the public agency
and the federal court. Under the agreement, the federal court would be required to notify the
county election office if a potential juror is not a United States citizen.
The Kansas Secretary of State indicates HB 2052 that existing resources would be used to
develop and accept the executed agreement required under the bill. The Kansas Judicial Branch
indicates any fiscal effect of HB 2052 would be negligible. The Kansas Department of Health and
Environment and the Department of Revenue indicate the bill would not have a fiscal effect. Any
fiscal effect associated with HB 2052 is not reflected in The FY 2024 Governor’s Budget Report.
The Kansas Association of Counties indicates HB 2052 would have a negligible fiscal
effect since counties are seldom notified of jurors that are not United States citizens.
