SUBJECT: Fiscal Note for HB 2046 by House Committee on Federal and State Affairs
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2046 is
respectfully submitted to your committee.
HB 2046 would amend current law to remove parental, legal guardian, and judicial
exceptions allowing individuals 15 to 17 years of age to marry and would require that marriage
licenses be issued only to applicants who are least 18 years of age. The bill would also modify the
three-day waiting period between the application for a marriage license and issuance to exclude
Sunday, holidays, and other days the clerk’s office is closed.
The Office of Judicial Administration states enactment of the bill would have a fiscal effect
on the operations of the Judicial Branch because the bill’s provisions would reduce the number of
marriage license applications processed by district court clerks. Enactment of the bill would also
reduce the workload of judges and clerks because there would no longer be the need for judicial
review or review of parental consent. The Office indicates enactment of the bill could result in a
decrease of revenue to the State General Fund if the number of marriage licenses applications
decreases. The Office states a fiscal effect cannot be estimated until the Judicial Branch has an
opportunity to operate under the bill’s provisions. Any fiscal effect associated with HB 2046 is
not reflected in The FY 2024 Governor’s Budget Report.
