Dear Representative Proctor:
SUBJECT: Fiscal Note for HB 2038 by House Committee on Elections
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2038 is
respectfully submitted to your committee.
HB 2038 would require any accredited postsecondary educational institution in Kansas that
issues a student identification card to a student and knows the student is not a citizen of the United
States or is otherwise not a legally qualified voter to include the following statement on the front
of the student’s identification card: “Cannot be used for voting purposes.” Postsecondary
educational institutions would include any public university, municipal university, community
college and technical college as well as any entity resulting from the consolidation or affiliation of
any two or more of such postsecondary educational institutions. The bill includes technical
amendments.
The Kansas Board of Regents indicates the passage of HB 2038 would require
postsecondary educational institutions to replace student ID cards for any current students who are
not United States citizens. The Board estimates cost ranges between $100,000 and $250,000,
which was determined by taking the approximately 10,000 students systemwide, who would need
a new card, and multiplying the estimated cost per card, which ranges from $10 to $25.
The Office of the Secretary of State indicates the enactment of HB 2038 would require it
to provide training and updated manuals for county election officials; update the agency website,
documents and information provided to the public; and work with media, political parties,
candidates, and the general public to ensure knowledge of the new requirement. However, the
Office indicates the fiscal effect associated with these activities would be negligible could be
absorbed within existing resources. The Office indicates county election offices would be required
to update information provided to the public, update training materials for board workers, and

conduct public outreach. The Kansas Association of Counties indicates the requirements of HB
2038 would have no fiscal effect on counties. Any fiscal effect associated with HB 2038 is not
reflected in The FY 2024 Governor’s Budget Report.
