SUBJECT: Fiscal Note for HB 2022 by House Committee on Corrections and Juvenile
Justice
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2022 is
respectfully submitted to your committee.
HB 2022 would place the Kansas Highway Patrol under the jurisdiction of the Attorney
General beginning July 1, 2023. The bill would transfer all powers, duties and functions
concerning the Highway Patrol to the Attorney General. The bill would deem every act performed
in the exercise of such powers, duties, and functions under the authority of the Governor to have
the same force and effect if performed by the Attorney General after July 1, 2023. The bill would
make any statutory reference regarding the Governor and the Highway Patrol apply to the Attorney
General and the Highway Patrol. All orders and directives of the Governor concerning the
Highway Patrol in existence on July 1, 2023, would continue to be effective and deemed to be
orders and directives of the Attorney General until revised, amended, or nullified. The
superintendent of the Highway Patrol would hold office at the pleasure of the Attorney General.
The Highway Patrol indicates the Attorney General would have discretion to determine
whether changes to operations are made, including any decisions to change the name, logo, or
other attributes of the agency. Certain changes could require additional expenditures to update
vehicles, uniforms, facility signage, stationary, online information, and printed marketing
materials. However, a fiscal effect cannot be estimated.

The Attorney General indicates enactment of the bill would have no fiscal effect on its
operations because the Highway Patrol would retain its own budget authority and would not be
part of the Attorney General’s budget. Any fiscal effect associated with HB 2022 is not reflected
in The FY 2024 Governor’s Budget Report.
