SUBJECT: Fiscal Note for HB 2523 by Representative Highland
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2523 is
respectfully submitted to your committee.
HB 2523 concerns the Board of Veterinary Examiners and the regulation of licensed
veterinarians and registered veterinarian technicians when conducting investigative and
disciplinary proceedings and assessing penalties and fees resulting from those proceedings. The
bill would redefine and add statutory definitions and requirements for investigative and
disciplinary proceedings and would allow the Board to assess fees to recover the actual costs of
the proceedings which would be deposited in the Veterinary Examiners Fee Fund. The bill also
makes technical changes to the Kansas Veterinary Practice Act.
The Board of Veterinary Examiners states that the new fees allowed under the provisions
of HB 2523 would be limited to additional costs resulting from performing investigatory and
disciplinary hearings. Therefore, any increase in fee revenue would be directly offset by an
increase in expenditures. Because the number and complexity of these proceedings cannot be
estimated, the agency cannot estimate a fiscal effect. Any fiscal effect associated with HB 2523
is not reflected in The FY 2023 Governor’s Budget Report.
