The Honorable Mike Thompson, Chairperson
Senate Committee on Utilities
Statehouse, Room 225B-E
Topeka, Kansas 66612
Dear Senator Thompson:
SUBJECT: Fiscal Note for SB 223 by Senate Committee on Ways and Means
In accordance with KSA 75-3715a, the following fiscal note concerning SB 223 is
respectfully submitted to your committee.
SB 223 would amend existing law concerning eminent domain to include carbon dioxide
in pipes as one of the substances that may be conducted through land appropriated by various types
of companies or corporations including road, oil, pipeline, hydraulic and public utilities, using
eminent domain to gain access to that land.
According to the Kansas Corporation Commission, enactment of SB 223 would have no
fiscal effect on the agency. The Kansas Association of Counties and the League of Kansas
Municipalities both indicate that enactment of the bill could have some fiscal effect related to
notifications and the use of eminent domain but are unable to estimate what that effect might be.
Sincerely,
Adam Proffitt
Director of the Budget
