Dear Representative Carpenter:
SUBJECT: Fiscal Note for HB 2249 by House Committee on Appropriations
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2249 is
respectfully submitted to your committee.
HB 2249 would require the Secretary of the Kansas Department of Health and Environment
(KDHE) to adopt rules and regulations to set the monthly protected income level for purposes of
determining any such person's client obligation at an amount equal to 150.0 percent of federal
Supplemental Security Income for any person receiving Home and Community-Based Services
under the Kansas Medical Assistance Program. This would include any person receiving services
from a Program of All-inclusive Care for the Elderly approved by the United States Centers for
Medicare and Medicaid Services. The Secretary would also be required to amend these rules and
regulations on an ongoing basis as necessary to adjust the protected income level for any increase
to federal Supplemental Security Income.
KDHE indicates that enactment of HB 2249 would have no fiscal effect on expenditures.
The bill would codify in statute a policy that has been in effect since FY 2019 through the use of
appropriations bill provisos.
