                                                    February 8, 2021
          The Honorable Kellie Warren, Chairperson
          Senate Committee on Judiciary
          Statehouse, Room 441B-E
          Topeka, Kansas 66612
          Dear Senator Warren:
SUBJECT: Fiscal Note for SB 54 by Senate Committee on Ways and Means
In accordance with KSA 75-3715a, the following fiscal note concerning SB 54 is
          respectfully submitted to your committee.
SB 54 would authorize judges to extend protection from abuse orders when the defendant
has committed an act that is substantially similar to certain crimes against the plaintiff or any other
person. The bill would also toll the time a protection order is valid when the defendant is
          incarcerated.
The Office of Judicial Administration states enactment of SB 54 could result in additional
time spent by district court judges reviewing protection from abuse orders to determine if the order
should be extended. According to the Office, a fiscal effect cannot be estimated.
The Kansas Sentencing Commission states enactment of the bill could have an effect on
prison admissions and beds; however, the Commission does not have enough information to
estimate what the effect would be. The Department of Corrections states there would be no fiscal
effect on agency operations if the bill is enacted. Any fiscal effect associated with SB 54 is not
reflected in The FY 2022 Governor’s Budget Report.
                                                                 Sincerely,
                                                                 Adam Proffitt
                                                                 Director of the Budget
