SUBJECT: Fiscal Note for SB 261 by Senator Faust-Goudeau
In accordance with KSA 75-3715a, the following fiscal note concerning SB 261 is respectfully
submitted to your committee.
SB 261 would enact the Roy’Ale Spencer Firearm Safety Act. The bill would establish
guidelines for how a loaded firearm must be secured from a person under the age of 18 years.
Violations of this Act would be a class C misdemeanor.
The Kansas Highway Patrol states that the enactment of this bill would a have negligible effect
on its operations and could be absorbed within existing resources.
The League of Kansas of Municipalities indicates that the bill could increase costs to local
law enforcement tasked with enforcing this Act. Prosecutorial costs could affect cities and district
attorneys as cases against individuals are filed under the provisions of this Act. In addition, municipal
courts could see increased costs to hear these cases. However, the number of incidents that would
occur are unknown and therefore the fiscal impact cannot be determined.
The Kansas Association of Counties believes that offenses resulting from this bill would be
rare and that the fiscal effect for counties would be negligible. The Office of the Attorney General
states that passage of the bill would not have a fiscal effect on its operating expenditures. Any fiscal
effect associated with SB 261 is not reflected in The FY 2021 Governor’s Budget Report.
