SUBJECT: Fiscal Note for SB 247 by Senator Hilderbrand
In accordance with KSA 75-3715a, the following fiscal note concerning SB 247 is
respectfully submitted to your committee.
SB 247 would prohibit cities and counties from implementing, operating, or contracting
for the operation of a photographic traffic signal enforcement system on and after July 1, 2020,
with respect to a highway or street under the jurisdiction of the city or county. Cities and counties
would also be prohibited from issuing citations for violations based on a recorded image produced
by a photographic traffic signal enforcement system on and after July 1, 2020. The bill defines
“photographic traffic signal enforcement system.”
The League of Kansas Municipalities states that while its research does not show the use
of any automatic photographic traffic signal enforcement systems by local governments, there
could be a potential that a prohibition could have a fiscal effect on cities because the bill could
make it more difficult for law enforcement officers to perform their job in the event of infractions
and motor vehicle accidents. Currently, officers may view traffic footage when an accident occurs,
and the bill would prevent this type of active review.
The Kansas Association of Counties cannot estimate what, if any fiscal effect, enactment
of SB 247 would have on counties.
