SUBJECT: Fiscal Note for HB 2110 by Representative Rhiley, et al.
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2110 is
respectfully submitted to your committee.
HB 2110 would amend the No Call Act by adding text solicitation to controlled
communications, making them subject to the same restrictions on solicitations that apply to
telephone solicitation. The bill would also add restrictions to robocalling and prohibit
manipulating caller ID, or making calls knowing caller ID has been manipulated, with the intent
to defraud, cause harm or wrongfully obtain anything of value. The bill would include technical
amendments.
The Office of the Attorney General (OAG) indicates HB 2110 could increase revenues
from violations for no call penalties by up to $10,000 per violation. However, because of the
nature of robocalls and fraudulent text message solicitations being largely originated from overseas
call centers beyond its reach, the OAG estimates the increase would be negligible. Any fiscal
effect associated with HB 2110 is not reflected in The FY 2020 Governor’s Budget Report.
