Summary of Legislation: This bill prohibits the State Board of Education from distributing Human
Immunodeficiency Virus literature to students without the consent of the governing body of the school
corporation the students attend. It requires instruction in state accredited schools on human sexuality or
sexually transmitted diseases to be based on information that is medically and scientifically accurate and age
appropriate. It also lists the criteria that instruction on human sexuality and sexually transmitted diseases
must meet.
Effective Date: July 1, 2022.
Explanation of State Expenditures: This bill eliminates the requirement that the State Board of Education
(SBOE) must provide information to students regarding the prevention of Human Immunodeficiency Virus
(HIV). It also prohibits the SBOE from distributing HIV literature, as prescribed in this bill, to students
without the consent of the governing body of the school corporation which the student attends.
This bill requires that, not later than November 1, 2024, and each year thereafter, the Department of
Education (DOE) must receive an annual report from each school corporation regarding the curriculum used
by the school to provide comprehensive sexual health education. The DOE must submit the results of these
reports to the chairperson of the House Committee on Education and the chairperson of the Senate
Committee on Education and Career Development. These requirements are within the routine administrative
functions of the SBOE and the DOE and should be able to be implemented with no additional appropriations,
assuming near customary agency staffing and resource levels.

Explanation of Local Expenditures: This bill modifies the requirements for the curriculum and the teaching
of human sexuality and sexually transmitted diseases for school corporations and charter schools. School
corporations and charter schools may need to update their curriculum and course offerings to meet the
requirements of this bill, and must ensure they have the staff available to teach the required curriculum. Any
increase in expenditures from this requirement will depend on local action.
This bill also requires school corporations to submit an annual report to the DOE, beginning in 2024,
regarding the curricula used to provide comprehensive sexual health education.
These requirements are within the routine administrative functions of school corporations and charter schools
and should be able to be implemented with no additional appropriations, assuming near customary staffing
and resource levels.
