Summary of Legislation: Dentist Supervision - This bill amends the definition of "prescriptive supervision"
concerning circumstances under which a licensed dentist is not required to be present in a facility when
patient care is provided by a dental hygienist. It restates restrictions on use of a laser by a dental hygienist.
It also provides that a dental hygienist may administer topical local dental anesthetics, other than nitrous
oxide or similar analgesics, without supervision.
Nitrous Oxide - The bill prescribes requirements for administration of nitrous oxide by a dental hygienist or
a dental assistant. It provides, for purposes of regulation of dental hygienists, that a person, other than a
dentist, a physician, or a dental assistant who administers nitrous oxide is considered to be practicing dental
hygiene.
Continuing Education - The bill removes a limitation on the number of credit hours earned for certification
in basic life support that may be applied to a dental hygienist's continuing education requirement. It provides
that there is no limit on the number of credit hours a dental hygienist may earn for completion of an approved
course offered by another dental hygienist.
Effective Date: July 1, 2020.
Explanation of State Expenditures: The Professional Licensing Agency (PLA) may incur minimal
additional workload to notify license holders of the changes made by the bill and post information to the PLA
website. These actions are within PLA’s routine administrative functions and should be able to be
implemented with no additional appropriations.

Explanation of State Revenues: Summary - Dentists and dental hygienists that violate any law or regulation
governing their profession are subject to disciplinary action by the Board of Dentistry, which may impact
the state General Fund. The extent to which violations by dental hygienists may increase or decrease as a
result of the changes to dentist supervision requirements for anesthetics and nitrous oxide administration
is indeterminate. Any impact on General Fund revenue is expected to be minimal.
Additional Information - Upon violation of the bill’s requirements by a dentist or dental hygienist, the Board
of Dentistry may revoke or suspend the practitioner’s license or assess a maximum fine of $1,000 to be
deposited in the General Fund. License revocation or suspension would result in foregone General Fund
revenue in the amount of $100 biennially for dentists and $50 biennially for dental hygienists.
