Orders, pursuant to the Illinois Emergency Management Agency Act, that neither the Department of Revenue nor the Illinois State Police shall impose a penalty when dyed fuel is sold or used from bulk storage for use on highways and State roads for farming and agricultural purposes through December 31, 2026. Directs the Department of Revenue to issue guidance explaining how it intends to implement this penalty relief. Further directs the Department of Revenue to request federal penalty relief from the Internal Revenue Service for the highway use of dyed diesel fuel in accordance with Internal Revenue Manual 25.16.1.5 and the Presidential Executive Order addressing Emergency Tax Relief on Dyed Diesel Fuel entered October 5, 2026, to provide additional relief as the diesel shortage intersects with the fall harvest season. Provides that the Department of Transportation shall consider extending the Illinois Harvest Program to provide additional relief if the diesel shortage continues. Provides that the executive order shall not be construed to contravene any federal or State law or regulation. Further provides that the executive order shall not affect or alter the existing statutory powers of any State agency. Specifies that the provisions of the executive order are severable. Effective October 6, 2026.
