Amends the Criminal Code of 2012. Provides that a person commits domestic battery if he or she knowingly without legal justification by any means engages in coercive control over a family or household member. Defines "coercive control". Amends the Protective Orders Article of the Code of Criminal Procedure of 1963 and the Illinois Domestic Violence Act of 1986. Includes coercive control in the definition of "abuse". Defines "coercive control".
House Floor Amendment No. 1: Replaces everything after the enacting clause. Amends the Consumer Installment Loan Act. Provides that in any lawsuit or arbitration to collect a debt, subject to the Act, it is an affirmative defense that the debt is or is partially coerced debt to the plaintiff and the court or arbitrator. Provides that a plaintiff has the burden to disprove the debtor's defense by a preponderance of the evidence. Defines "coerced debt".
Senate Committee Amendment No. 1: Deletes a provision that a plaintiff has the burden to disprove the debtor's defense by a preponderance of the evidence.
